You can file a suit for partition and possession of the property and savings meant for your son. You can file this suit in the court of your residence as long as the property is situated within the jurisdiction of Indian courts. As a widowed single mother, you may be eligible for certain exemptions on stamp duty and court fees, but specific eligibility criteria and applicable rates vary by state.
