My grandfather, whom we’ll call “Baba,” passed away, leaving behind six children – three sons and three daughters. He divided his land equally among them, but it was only documented through a will and not officially registered. My brother, “Bhaiya,” bought the shares of his siblings, including the sisters, but never acquired mine. Now, he’s claiming possession of my rightful share and has even put up a fence. How can I reclaim my land and prevent him from using it? What legal steps can I take to ensure he doesn’t benefit from my portion?

You can file a suit for partition and possession of your share of the land in a civil court. Since the will was not registered, the court may consider it as evidence of your grandfather’s intentions. You can also seek an injunction to prevent your brother from using the land while the case is pending.
