My friend had a terrible experience with a builder who cheated him. I introduced him to an agent I’ve known for six years, who works exclusively with a builder called M/S.xxx. He booked two office spaces in a new commercial project and paid the full amount of ₹45 lakhs by cheque in June 2014. The builder promised completion within 18 months and gave him an allotment letter saying the project would be finished by early January 2016 or his money would be refunded. The builder never started the project, and has only refunded ₹2.3 lakhs so far. Now, the builder is asking for receipts for every refund he makes. Is it right to give them receipts?

Under Indian law, the builder is obligated to complete the project as per the agreement or refund the entire amount. Your friend is not legally obligated to provide receipts for each refund as it is the builder’s responsibility to maintain records of payments made. The builder’s demand for receipts is likely an attempt to delay the full refund process.
