My father recently sold his ancestral home and bought an apartment. He’s planning to give this apartment to one of his three children – two sons and a daughter. Is he legally allowed to do this? He’s never worked or started any business. What are our options?
Best Answer
Yes, your father is legally allowed to gift the apartment to any of his children. As the property is acquired from sale proceeds of ancestral property, it becomes his self-acquired property. He has the right to dispose of it as he wishes. You can discuss amongst yourselves and arrive at a mutually agreeable solution or approach the court if necessary.
