My father passed away leaving behind a property he had acquired himself. My mother has also passed away. I have a younger brother and we both have families living on the property. My elder brother recently passed away, leaving his wife without children. Sadly, neither my father nor my mother left a will. Now, my brother’s wife is claiming a share in the property. Could you please explain what the law in India says about a Christian widow’s rights in her deceased father-in-law’s property? Are there any specific sections of the law that apply to this situation?

In India, under the Indian Succession Act, 1925, a Christian widow is entitled to inherit her deceased husband’s property. Since your father left no will, the property will be divided equally among his legal heirs, including your brother’s wife. Section 15 of the Act states that a widow is a Class I legal heir and receives a share in the deceased’s property.
