My father passed away a year ago without leaving a will. We have three children, two sons and one daughter, and my mother. We had decided to sell our father’s property and split the earnings equally. However, my elder brother has separated from the family and lives alone, leaving my mother by herself. I work in Hyderabad, and all three of us are married. My father had verbally given us specific responsibilities, but my brother refuses to take them on. He only wants his share of the property and is refusing to give any to my sister or mother. What should we do?

Since your father passed away without a will, the property will be divided according to the Hindu Succession Act, 1956. Your mother and all three siblings will inherit the property equally. Your brother’s refusal to share or contribute towards your mother’s welfare is a violation of familial responsibilities and can be challenged legally, potentially leading to a partition of the property in your favor.
