My family, practicing Buddhists, inherited ancestral land that was registered under my cousin’s name. Our grandfather and father’s names were missing from the property documents. However, we continued to possess the land. In September 2013, my cousin sold the property, and we bought it back in January 2014. We were unaware of the sale for three years and she didn’t inform us. Now, the land is officially registered in our names with the 7/12 extract.
My cousin is now claiming the property and has filed a case against us under sections 156, 418, 420, 468, 471, and 34 of the Indian Penal Code. The case is still under investigation at the police station. Oral statements are ongoing, but not complete.
I’m worried about the possibility of arrest. Should I seek bail beforehand? Could we get the property back, or should we fight the case? What are our options? My cousin is demanding a refund, and he’s named himself, us, and a witness in the case. Please advise.
