My family is thinking about buying a property from Mr. Sharma. The property is registered in his wife’s name, but unfortunately, she passed away unexpectedly without a will. Mr. Sharma has two young children. What steps need to be taken so he can legally sell the property without any issues from his children?

Under Indian law, the property will be inherited by Mr. Sharma’s children as his wife died intestate (without a will). To sell the property, Mr. Sharma needs to obtain consent from his children, either through a court-appointed guardian or by obtaining a legal guardian for them.
