My family follows Hindu customs. My father owned three properties. He gifted the first to my wife a long time ago, and the second to my brother just before he passed away. My brother has never been a good son, and he and his wife even mistreated my parents. They never helped my parents when they were sick or needed support. Now that my father has passed, my mother lives alone in the third property, which was acquired by my father himself. Can my brother still claim a share in this last property?

Under Indian law, your brother may have a claim on the third property based on his legal right as a son. However, the extent of his claim can be contested in court. The court may consider the nature of your brother’s relationship with your parents, including his conduct and financial contributions, in determining his share.
