My family and I recently bought a flat in a new building. The builder finished the interior work, but the amenities are a mess! The gym, pool, and common areas are tiny, and the parking is so small that only a few of the 30 residents can fit their cars. The security, main gate, and building signage are incomplete too. We’ve been trying to contact the builder for months, but he’s not responding. Some of us have registered our flats, but others haven’t. We’re paying huge EMIs, but there’s no security, and the ground and first floors are unfinished because of a land dispute. Only the second, third, and fourth floors are occupied, and the whole thing just looks shabby and incomplete. Is there anything we can do legally?
You have grounds to take legal action against the builder. You can file a complaint with the Real Estate Regulatory Authority (RERA) or the Consumer Forum, citing breaches in the agreement and seeking completion of the amenities and rectification of defects. Since the builder is not responding, you can also consider approaching the court for a decree of specific performance.
