My cousin, who served in the CRPF, named his ex-wife and mother as beneficiaries in his will. Now, his young widow, who’s only 25 and works in government service, is claiming 70% of his assets. She has no children and won’t live with his family, so she won’t help his elderly parents. Is it possible for her to get half the assets even though he didn’t nominate her? If so, why? Could you explain this?

Under the Hindu Succession Act, a widow is entitled to a share of her deceased husband’s property even if he did not nominate her in his will. She is entitled to a minimum of 1/2 of his property, and can claim more if the circumstances warrant it. The widow’s age, employment, and the fact she won’t live with his family don’t change her legal right to inherit.
