In Greater Noida West, builders are demanding an additional 20% of the basic price at the time of possession, claiming it’s for escalation and farmer compensation. They included a one-sided agreement mentioning the “company can raise any additional demand at any time”. They say they paid farmer compensation in 2012 and resumed work in 2013, paying more. However, this hike wasn’t disclosed until possession, kept hidden for four years. This seems like a clear case of cheating and fraud.
My questions are:
1. A group is approaching the National Consumer Disputes Redressal Commission (NCDRC). How long will it take approximately to resolve the case?
2. My additional payment is around ₹4 lakhs. Can I file a case in the District Court and also in the NCDRC?
3. If the group is going to the NCDRC, can I file a separate case in the District Court as an individual?
4. How long will it take approximately for a case to be resolved in the District Court?
Best Answer
1. NCDRC cases can take several years to resolve, depending on the complexity and the number of appeals.
2. While you can file a case in the District Court and NCDRC for the same issue, it’s not recommended as it can lead to conflicting judgments.
3. You can file a separate case in the District Court even if a group case is pending in the NCDRC, but it’s advisable to consult with a lawyer to avoid any potential legal complications.
4. A District Court case can take a few years to resolve, depending on factors like evidence, arguments, and court workload.
