My marriage in June 2013 ended in September that year. I gave her a divorce according to Islamic law in January 2014, including all her due payments. However, she hasn’t withdrawn the money. She filed a Domestic Violence case against me and my family in March 2014, and also challenged the divorce. Since she left in September 2013, can the DV case be dismissed as it was filed after she had already left?

Under Indian law, a Domestic Violence case can be filed even after separation if the abuse occurred during the marriage. The fact that she left in September 2013 does not automatically dismiss the case. The court will consider all evidence, including the timing of the filing and the nature of the alleged abuse, to determine if the case is valid.
