Last Friday, my cousin was in an accident while riding his bike. The bike collided with a Maruti van. He suffered three fractures on his face. During the medical examination, the doctor mentioned “alcohol present” in the report. However, no test was conducted to confirm this. When asked, the doctor said he could smell alcohol and hence added it to the report. We requested the inspector to register a case but he refused, claiming that my cousin was drunk and he won’t register the case. He suggested approaching the court if we want to proceed. What should we do in this situation?

You should file a complaint with the police station concerned, demanding an investigation and registration of a FIR. If the police refuse, you should approach the Magistrate’s Court for the same, citing the police’s inaction and the doctor’s lack of proper testing.
