My uncle and his cousin lived together for 30 years. My uncle made a will leaving the property to his cousin. He passed away in 1996, and in 1999, the rest of the family moved out, leaving the property to my uncle’s cousin. He started paying rent by cheque, promising to change the rent receipt to his own name but delaying. He’s been doing this for 15 years, but the receipts still haven’t changed. Now he’s been served with an eviction notice claiming subletting. What can we do?
Best Answer
The eviction notice based on subletting may be invalid if your uncle’s cousin was a rightful tenant based on the will. However, the lack of name change on the rent receipts could be used against him. Seek legal advice to determine if the eviction notice is valid and explore options for challenging it based on the specific facts of the case.
