My shop has an old tenant paying a very low rent of ₹250 per month. We filed a case to increase the rent, initially demanding ₹20,000, but the court settled it at ₹10,000. We appealed, and the higher court set it at ₹7,000. Can I now file a case under Section 106 against the tenant?

You can’t file a case under Section 106 against your tenant. This section deals with harassment by landlords, not tenants. You can, however, approach the court again to review the rent based on prevailing market rates. Remember, the court will consider factors like the property’s condition and its location while deciding the rent.
