My grandmother rented two rooms to a family about 40 years ago. The tenant passed away years back, and now his son, along with his wife and 3 children, are living there. They own two other houses where the remaining family members stay. We’ve tried multiple times to reclaim those rooms, but they consistently refuse. We only have one room, with six family members, including my two brothers and sister, all of whom are of marriageable age but facing difficulties due to this situation. We can’t afford the exorbitant rent they demand, and whenever we try to discuss it, they resort to verbal abuse.

Under Indian law, the tenant’s son has no automatic right to inherit the tenancy as it was a personal agreement with his father. You have the legal right to reclaim the rooms. However, since the tenancy existed for over 12 years, you might need to approach the court for eviction, and provide sufficient evidence of your ownership and the tenant’s refusal to vacate.
