My grandfather rented out the ground floor of our property in New Delhi to an unmarried woman in 1981, without a written agreement. She lived alone with servants. Sadly, she has passed away, and we’ve learned that her relatives are trying to move into the ground floor without our permission. They claim their daughter was adopted by our tenant and she’s asked them to stay. The rent was a nominal ₹2,500, so it doesn’t fall under the Rent Act. They haven’t paid rent for the last three months. How can we get back possession of our property?

As the rent agreement was oral and doesn’t fall under the Rent Act, you can legally evict the occupants. Since the tenant has passed away and her relatives are not legal successors to the tenancy, they have no legal right to occupy the property. You can file a civil suit for eviction and claim possession of your property.
