My family rented out our house in South Delhi back in 2013. We had a one-year agreement that we renewed in 2014 and 2015. In 2016, when the lease ended, we asked the tenants to move out because they were often late with the rent, and even missed a month’s payment in February 2015. They agreed to leave within a month. We didn’t renew the agreement. But, they didn’t leave after a month and instead asked for four more months, which we agreed to in writing. Even after those four months, they asked for another month to move out as they were short on funds. We gave them that extra month, but they’re still there and haven’t paid rent for the last two months. If we go to court, how long might it take to get them out of the house?

Under Indian law, since the tenancy agreement expired in 2016 and you have a written record of their agreement to vacate, you have a strong case. However, eviction proceedings can take several months depending on the court’s schedule and the tenant’s response. It’s advisable to consult a lawyer for specific guidance and to expedite the process.
