Namaste! I’ve been working at Jetinks Pvt Ltd for almost 10 years and resigned on October 26th, 2016. They released my October salary in November and the notice period salary in December. However, they accepted my resignation with immediate effect and haven’t communicated further. I’ve sent several emails requesting my full and final settlement, but haven’t received any response. I believe they’re waiting for me to join a competitor so they can withhold my dues, but I’m still unemployed. I’m owed two months’ salary, leave encashment, incentive, and bonus, but they haven’t provided a breakdown of the total amount. After filing a grievance with the EPF office, they applied for my EPF withdrawal. Could you please advise me on how to recover my hard-earned money? Thank you.

You can file a claim for unpaid dues with the Labour Court under the Industrial Disputes Act, 1947. Since your resignation was accepted with immediate effect and Jetinks Pvt Ltd released your October salary and notice period salary, you are likely entitled to the remaining dues. You should demand a detailed breakdown of the amount owed and pursue legal action if they fail to provide it or settle the dues.
