I worked in a semi-government department in Himachal Pradesh from 1998 to 2007. I was unfortunately terminated but later pursued other career opportunities. In 2016, the HP government announced openings for clerical positions, where each year of relevant experience earned a point in the selection process. However, they disregarded my 8+ years of prior experience due to the gap between 2007 and 2015. Can I legally challenge this decision?
Best Answer
You might be able to legally challenge this decision. Indian law generally favors recognizing prior experience, and excluding your relevant service due to a gap in employment may be considered discriminatory. You could argue that your termination was not your fault and your experience remains valuable, especially in a semi-government setting. It is advisable to consult a lawyer specializing in employment law to explore your legal options.
