I worked at a school for seven years. When I was pregnant for the first time, they gave me unpaid leave. However, they refused leave during my second pregnancy, even though they assured me they would call me back. I left in August 2014, and they cleared my PF in February 2015. I later learned about gratuity and, after arguing, they paid it in August 2015. I was five months pregnant at the time and want my job back. I don’t have an appointment letter, but I have an experience certificate signed by them. They won’t pay gratuity, bonus, or leave encashment, but they did pay my gratuity after I showed them legal papers. Can I do anything to get my job back?

While the school’s actions regarding your maternity leave and subsequent dismissal appear unfair, Indian law doesn’t automatically guarantee you your job back. However, you can explore options like filing a complaint with the labor department or approaching a court, presenting evidence of your employment, your experience certificate, and their past gratuity payment. The outcome depends on the specific circumstances and legal arguments.
