I retired from a public sector company (PSU) in June 2016. My gratuity, leave encashment, and pension commutation are withheld due to an ongoing vigilance case. This case involves a fraud where over 30 employees were affected due to account manipulation using stolen passwords. I received a letter from my former employer in September 2014, requesting clarification on a ₹95,000/- adjustment voucher I prepared. I provided the clarification within 10 days, explaining that the voucher was prepared following company guidelines and that I was not involved in any fraud or negligence. Despite this, I haven’t received any show cause notice or further communication. Upon my retirement, I was informed that my benefits were stopped due to the vigilance case, but I’m unaware of the specific allegations against me.

Under Indian law, your employer has a right to withhold your retirement benefits if a vigilance case is ongoing. However, you have the right to know the specific allegations against you and be given an opportunity to respond. You should seek clarification from your former employer about the specific allegations and request a hearing to present your case.
