Hi everyone, I need some advice. I’ve been working at an NBFC for the past three years, but I want to switch to the banking sector. I submitted my resignation with a 30-day notice period on December 20th, 2016. However, after 15 days, my company abruptly transferred me to Kerala on January 6th, 2017, even though I was working in Jalandhar, Punjab. The HR department told me I had to choose between working in Kerala or leaving the company, but they refused to give me a relieving letter. This transfer was completely unexpected and without any prior notice. I have 21 leave days remaining, and I’ve already served my 15-day notice period. Is it legal for an employer to transfer an employee like this? I need a relieving letter for my next job. Could this affect my three years of experience and career? What should I do? Any suggestions would be greatly appreciated.

Indian law generally allows employers to transfer employees within the company, even without prior notice. However, your employer’s actions seem unreasonable and may be in violation of your employment contract and service rules. You have a right to a relieving letter, and it’s advisable to seek legal advice to understand your options and proceed with your resignation. Your experience shouldn’t be affected if you have proper documentation.
