We’re planning a simple, court marriage under the Special Marriage Act, as we’re both Hindus and prefer a smaller celebration. Is it necessary for both of us to be present when applying? Also, can one of us apply in our own state, where we’ve been living for over a month?

Under the Special Marriage Act, both parties must be present to apply for a marriage certificate. You can apply in the state where either of you has resided for at least 30 days prior to the application, regardless of where you were born.
