We got married 3 months ago after knowing each other for 3 years. We had a traditional Hindu wedding with over 100 guests but haven’t registered it. We’ve been living under the same roof but in separate rooms. We want to end this marriage amicably. We haven’t consummated it and agreed to it due to family pressure. He had an affair before the wedding but not after. Can we get an annulment due to fraud or pressure? If not, can we file for a mutual divorce even though we’ve only been separated for 3 months? What’s the earliest we can file and finalize the divorce process?

Under Indian law, you can’t seek annulment based on pre-marital affairs or family pressure. However, you can file for a mutual divorce, even after only 3 months, as you’ve not consummated the marriage. The earliest you can file is after 1 year of marriage, but a mutual divorce can be finalized much faster with both parties agreeing and presenting evidence of irretrievable breakdown.
