My father passed away in August 2000, leaving behind around 5 acres of land in Madhya Pradesh. He had two sons, my brother and I, and one daughter (myself). Unfortunately, my brother and his wife also passed away in January 2000, leaving behind three children. My elder brother claims that their daughters have no right to the land. Is this true? My name was included in the land records at the time of transfer. Can he prevent me from claiming my share of the property? I need guidance on this matter.

Under Indian law, your brother’s children (your nieces) are legal heirs to their father’s share of the property. Your name being included in the land records at the time of transfer is relevant, but your brother cannot prevent you from claiming your share.
