My father has five brothers, including himself, and he’s the fourth eldest. Sadly, the oldest brother passed away, and the second brother is now the head of the family. He holds all the property documents that our grandparents earned, but has been selling off some of the land without our consent. When we ask him to sell the remaining properties and give us our rightful share, he either refuses or keeps delaying the process. What’s the best way to get what we’re owed? What steps should I take, and how long will it take to get our share of the property?

You can approach the court to file a partition suit demanding your share of the ancestral property. The court will appoint a commissioner to divide the property, and you will receive your share after the legal proceedings are completed, which can take several months or years depending on the complexity of the case.
