I’m Rajesh Srivastava, and my wife and I have been married for over 8 years. We haven’t been able to have a child due to complications with my wife’s health, including filariasis, tuberculosis, and blocked fallopian tubes. We’ve been seeking medical treatment for the past 5 years, including surgery, but haven’t been successful. Sadly, my wife’s behavior has also been challenging, and she’s been living with her family for the past 18 months. Given this situation, I have a few legal questions:
1. I’m a contractual employee in the health department. Can my wife legally demand expenses for staying at her parents’ house?
2. Can my wife legally accuse me of dowry harassment?
3. Considering our inability to have children and her health issues, can I legally seek a divorce?

Under Indian law, your wife is not entitled to claim expenses for staying at her parents’ house, as you’re providing for her. Accusing you of dowry harassment without evidence is illegal. While infertility is a ground for divorce, you must demonstrate genuine attempts at reconciliation and provide proof of her health issues impacting the marriage.
