We’ve been married since February 2014 and have a sweet little one who’s now nine months old. My wife keeps accusing me of having affairs, which is completely untrue. She doesn’t treat me or my mother with any respect, often using hurtful words. I’m at my wit’s end and feel divorce is the only way out. However, I don’t want to remarry, I just want to focus on raising our son. My only regret is that I used to drink a lot, which I’m ready to stop completely. But given her attitude, I’m not sure if we can salvage our relationship. We never formally registered our marriage, and her documents still have her father’s name. How can I go about getting a divorce while ensuring my son’s well-being?

In India, a divorce can be obtained based on grounds like cruelty and desertion. As you are not formally married, you can file a petition for judicial separation under the Special Marriage Act. You can also seek custody of your son in the same petition, emphasizing his best interests and your commitment to raising him.
