Based on your situation, you need to file a joint petition for divorce under Section 13B of the Hindu Marriage Act. The court will then grant you a cooling-off period of 6 to 18 months during which you will need to reaffirm your decision to divorce. Only after confirmation of your consent will the court grant a final decree.
