Under Indian law, paying maintenance as per a court order during a divorce case doesn’t necessarily weaken your position. However, your wife may argue that your consistent payment demonstrates your ability to continue providing maintenance, potentially impacting the final settlement amount.

I gave my husband ₹5 lakhs to release his claim on the house, which is mentioned in the divorce petition. However, he’s not giving me the necessary NOC from the society because he has outstanding dues. The society won’t issue the NOC to me because of these dues, as the house is jointly owned. Since I paid the agreed amount, how can I get the house registered under my name?
