My wife filed three cases against me in Kanpur, UP in 2012: 125 CRPC, 498A, and domestic violence. Recently, the fast track court ordered me to pay her ₹5,000 per month as interim maintenance under 125 CRPC, even though I submitted proof of my income, responsibilities, and her education and work history. The case is ongoing.
My questions are:
1. Could the monthly maintenance amount increase beyond the current ₹5,000 after the case concludes?
2. She’s demanding ₹10,000 per month in the domestic violence case, a room and bathroom in my Ahmedabad house (owned by my father), and wants to return home. Is it possible she could still get ₹10,000 per month and a room in my house, considering she’s already receiving ₹5,000 from me under 125 CRPC?
3. What about the 498A case, given she’s already getting ₹5,000 per month from me as maintenance? She has been living in Kanpur since June 2012.

Yes, the maintenance amount under Section 125 CRPC can be increased after the final judgment based on the evidence presented. It’s possible the court could grant her ₹10,000 per month in the domestic violence case, but it’s unlikely they would order you to provide her a room in your father’s house. The outcome of the 498A case depends on the specific evidence and legal arguments presented, but the ₹5,000 monthly payment under 125 CRPC could be considered when determining any further financial relief.
