My wife filed false charges against me under various sections, including 498A, 125, 125/3 and 127, two years ago. The Family Court and DV case court have now set an alimony amount. She refuses to grant a divorce, and I don’t want to reconcile. What legal options do I have to separate from her? Also, my sister has been living abroad for the past year. Could this lead to any future complications?

You can file for divorce on grounds of cruelty, irretrievable breakdown of marriage, or adultery, proving your wife’s false charges. Your sister’s stay abroad shouldn’t impact the divorce proceedings, but you may need to establish your residency and financial status for alimony payments.
