My wife and I have been living separately for the past three years. We’ve reached a point where it’s clear our compatibility has broken down. I’ve shared my desire for a formal separation, but she’s asking for a share of our home in exchange for signing the papers. She’s willing to keep living apart until this demand is met, before proceeding with the separation. I want to move on with my life and am eager to finalize this process as quickly as possible. What options do I have in this situation?

In India, a formal separation does not exist. You can either pursue a mutual divorce by consent or file for a divorce on grounds of irretrievable breakdown of marriage. Your wife’s demand for a share of the home can be negotiated through a settlement agreement or addressed in court proceedings.
