My sister’s husband passed away in October 2008. Since then, her in-laws have been making things difficult, refusing to give her her jewelry or her late husband’s shop. We filed a complaint with the women’s cell, and they referred the case to the Rohini court in Delhi. After a long struggle, the court ordered maintenance payments and allowed her to stay in her in-laws’ home. We’re planning to remarry my sister, who has a four-year-old child. Will her in-laws stop paying maintenance after she remarries? Will her child lose his rights to his father’s property?

Under Indian law, maintenance payments are typically terminated upon remarriage. However, your sister’s child’s right to inherit his father’s property remains unaffected by her remarriage. He will be entitled to his share of the inheritance as per the law of succession.
