Since your husband is unavailable and you have filed a police complaint about his disappearance, you can pursue a divorce on grounds of desertion. You can file for divorce under Section 13 of the Hindu Marriage Act. You can also approach a family court to secure interim maintenance for your son during the divorce proceedings.
