Under the Indian Adoption Regulations, your ex-husband’s consent is required for your son’s adoption by your current husband. You will need to file an application with the relevant adoption agency, proving your ex-husband’s whereabouts and obtaining his consent. If he refuses or is untraceable, you can petition the court for adoption with evidence of his non-participation in your son’s life.
