My divorce case in Bangalore is dragging on. I filed it a year ago, and even though the court sent notices to her through her home state court, there’s no response. My lawyer wants to publish a notice in the paper, but the judge won’t allow it, citing some High Court order. I’m not sure I believe that, as it seems like a common practice elsewhere. My lawyer is now suggesting sending a warrant or getting an order from the High Court, but I’m hesitant about both. What are my options?

In India, if service of summons is unsuccessful, publishing a notice in a newspaper is a recognized legal option under Order 5 Rule 20 of the CPC. However, the High Court may have issued specific orders restricting this practice in certain circumstances. Discuss the specific concerns with your lawyer to understand the reason for the judge’s refusal and explore alternative options, including seeking clarification from the High Court or pursuing a warrant for service.
