My brother is a Chartered Accountant earning around ₹60,000 a month. He’s been married for about a year and three months. They’ve been living separately for six months now. His wife is an interior designer earning about ₹20,000 a month. During settlement talks, they asked for ₹30 lakhs. If they proceed with a divorce, what kind of maintenance would she be entitled to?

Under Indian law, the wife could be entitled to interim and permanent maintenance based on her needs and the husband’s capacity to pay. The amount of maintenance is determined on a case-by-case basis considering factors like income, marital status, and duration of marriage. The court may also consider the wife’s earning capacity and her ability to support herself.
