I’m going through a divorce with my husband under the Hindu Marriage Act. He’s not cooperating with a mutual consent divorce and hasn’t responded to my petition. He’s filed for child custody and wants to restrict my child’s travel by preventing them from getting a passport. I need legal advice: 1) Can I travel on a business visa alone for work? 2) Can I travel with my child on a long-term visa for work in another country?

Under Indian law, your husband’s refusal to cooperate with a mutual consent divorce does not prevent you from traveling abroad. However, your child’s travel may be restricted if a custody order is in place. You need to seek legal advice to determine your child’s travel rights and whether you can obtain a passport for them.
