In India, a mutual consent divorce requires both parties to agree to the divorce and live separately for at least one year. You and your husband can file a petition for divorce under Section 13B of the Hindu Marriage Act, 1955, and the court will grant the divorce if satisfied with the terms of the agreement and the genuineness of your consent.
