Respected Sir,I am a Hindu woman. I got married in April 2012, but my husband abandoned me in October 2013. After a long legal battle, I finally received interim maintenance. However, my husband transferred his 2,500 square feet flat to his mother’s name after leaving me, preventing me from claiming any share. I want to know if I can seek accommodation in this flat or request separate accommodation. Also, do I have any legal claim or share in the property that was originally his but transferred to his mother’s name? I have heard about a recent High Court judgment concerning such cases. Please guide me. I still wish to stay with my husband, but he refuses.

Under Indian law, you may be able to claim accommodation in the flat or seek separate accommodation based on the circumstances of your abandonment. You may also have a legal claim to the property that was transferred to your husband’s mother if you can prove it was done to defraud you or prevent you from claiming your share. A recent High Court judgment may be relevant, but it’s crucial to consult a lawyer to understand your specific rights and options.
