My second marriage, after my first wife passed away, is facing challenges. My current wife has filed for maintenance, seeking a hefty sum of ₹75,000 per month. This is her second marriage as well, and she received ₹13 lakhs in alimony from her previous husband. Her petition states she earns a small amount, ₹3,000 per month, from her father’s school. However, she has also assaulted my mother, leading to charges filed against her. She has also locked me out of my classes, which were my primary source of income. I earned over ₹5 lakhs before these issues arose two years ago, but now earn a mere ₹10,000 per month due to the damage caused. We have a one-year-old daughter together. I’m seeking guidance to minimize or avoid the maintenance payment.

Indian law mandates maintenance for spouses, considering their needs and ability to earn. However, your wife’s assault on your mother and disruption of your income can be presented as grounds for reducing maintenance. Additionally, her previous alimony receipt and alleged income from her father’s school can be argued to demonstrate her financial capacity.
