My flat was booked in March 2010, with promised possession in December 2012. The agreement mentioned December 2013 as a buffer date, but now it’s December 2015 and the builder still hasn’t received the Occupancy Certificate. I’m stuck paying rent on a separate flat, incurring extra costs due to the delay. What legal steps can I take to claim compensation for this? What are my consumer rights in this situation, and how much compensation am I entitled to?

You can file a consumer complaint with the National Consumer Disputes Redressal Commission (NCDRC) or the State Consumer Disputes Redressal Commission (SCDRC) seeking compensation for the delay. You are entitled to compensation for the rent you’ve paid, the interest lost on your investment, and mental agony caused by the delay. The court may also direct the builder to expedite the Occupancy Certificate process.
