My family booked a flat in 2013, but we haven’t received possession yet. In 2015, the builder gave us a cheque that bounced. We sent a legal notice but were promised payment, so we didn’t pursue it further. However, the builder hasn’t paid, and we even filed a police complaint with others. They then gave another cheque which also bounced. Can we now approach the consumer court, and are there any other actions we can take?
Best Answer
Yes, you can approach the consumer court as the builder’s repeated failure to deliver possession and dishonoring cheques constitute a violation of consumer rights. You can also file a civil suit for specific performance, seeking court-ordered possession of the flat. Additionally, consider pursuing criminal charges for cheating under the Indian Penal Code, as the builder’s actions may constitute fraud.
