My family and I booked a flat in the Ekdant FNG project in Surajpur, Greater Noida, back in July 2012. We opted for a flexible payment plan and have paid almost the entire amount, except for a small portion of the additional charges. Now, the builder has stopped construction and is selling the construction materials and machinery on-site to settle debts with creditors. He clearly has no intention of finishing the project. The project was originally planned with five towers, each with 14 floors, but the builder has illegally increased the height of Tower A and B to 24 floors without consulting us. He even told the contractor to sell off the remaining materials on-site. I am left with no funds to pay the remaining amount. What legal options do I have? Which court should I approach?

You can file a consumer complaint against the builder in the National Consumer Disputes Redressal Commission (NCDRC) or the State Consumer Disputes Redressal Commission (SCDRC) in Uttar Pradesh, seeking compensation for the loss suffered due to the builder’s breach of contract and illegal construction. You can also file a civil suit in the relevant district court in Greater Noida, seeking a refund of the amount paid and damages for the builder’s illegal activities.
