My family and I booked a flat in Greater Noida West with a builder in July 2012. We signed the agreement in July 2013, promising possession within 3 years. That deadline passed in June 2016, and even with a 6-month extension, the project should have been completed by December 2016. However, the building is still only up to the 16th floor out of 22, with construction stalled across all 7 towers. We’ve already paid 70% of the cost, but with no progress in sight, we’re losing hope. Is there a way to get our money back, with interest, given the builder’s delay?

Under the Real Estate (Regulation and Development) Act, 2016, you have the legal right to seek a refund of your investment with interest if the builder fails to deliver possession within the agreed timeframe. You can file a complaint with the Real Estate Regulatory Authority (RERA) for redressal and seek compensation for the delay.
