I bought a flat in Kochi and was promised a dedicated car parking space in the sale agreement. But, when I took possession, there was no parking allocated to me. I was one of the first people to buy a flat. What legal options do I have to get my parking spot, especially since the builder can’t allocate one now? Should I try to get a refund for the parking cost from the buyers who got the last few flats?

You have legal recourse to enforce the promise of a dedicated parking space in your sale agreement. You can file a case in a consumer court or civil court seeking specific performance, compelling the builder to provide the parking space. Seeking a refund from other buyers is not a legal option, as the builder is responsible for fulfilling the contractual obligations.
