Dear Sir,
I recently booked a flat in Sector 93, Gurgaon. The agreement states that possession is due in January 2017, with a six-month grace period. However, given the current situation, it seems unlikely the builder will be able to deliver the flat by then. There might be a delay of two years or more. I’ve received a demand for payment from the builder. Should I pay, risking more money being tied up, or hold off?

Based on Indian law, you have the right to withhold payment if the builder fails to deliver possession within the stipulated time frame, including the grace period. However, you should consult with a lawyer to understand your specific rights and options, considering the delay’s potential cause and any clauses in your agreement.
